PMI Privacy Policy
The PMI Group, Inc., its subsidiaries and its affiliates (collectively referred to as "PMI," "we,""our," or "us") is committed to complying with applicable information privacy and security laws, and to helping our financial institution business partners (including but not limited to mortgage lenders, originators, aggregators, servicers, investors, government-sponsored entities, and housing agencies, whether or not policyholders or insureds, defined herein as "you" or "your") meet their own privacy and security compliance requirements. We are providing this notice to you in order to explain how we protect information that we obtain about consumers in the course of providing our services to you.
If one or more of our affiliates or subsidiary companies is subject to foreign privacy laws the policies adopted by such affiliate or subsidiary will apply. Please contact PMI's Privacy Office regarding our other privacy and data security policies.
Scope
This policy applies to all Private information that PMI obtains relating to individual consumers who receive financial products or services from you. This policy governs all PMI employees and any other person we authorize to access such consumers' Private information.
Information We Obtain
Applications submitted to either: a) PMI Mortgage Insurance Co. for mortgage guaranty insurance pursuant to our master policy terms, or b) PMI Mortgage Services Co. for contract underwriting services, or c) other PMI companies for mortgage guaranty reinsurance or financial guaranty reinsurance, may involve the transfer of Private information. We acknowledge that Private information we obtain from you, or that you are responsible for allowing us to obtain, is your property.
We obtain Private information about consumers from the following sources:
- Insurance applications, loan applications or other related documents you provide to us;
- Transactions between us or our affiliates and you or other customers; and
- Consumer reporting agencies and other sources of information we use in our efforts to protect against fraud and to mitigate losses.
Information Security and Accuracy
PMI will use a high degree of care to protect the security, integrity and confidentiality of Private information in our possession. We restrict access to consumers' Private information to those employees who are specifically authorized to know the information to provide you with financial products or services you have requested or authorized. Employees who have access to a consumer's Private information are required to protect it and keep it Private. In addition, we maintain physical, electronic, and procedural safeguards that comply with federal standards to guard consumers' Private information.
We also have internal controls to keep consumers' Private information as accurate and complete as we can. If you believe that any information about a consumer is inaccurate, please inform us immediately.
PMI will notify you in the event we have a reasonable belief that unencrypted Private information maintained by PMI has been acquired by an unauthorized person. We expect that you will notify consumers whose Private information has been so acquired, to the extent such notification is required by law.
Use and Disclosures of Information
PMI will not use or disclose Private information that we obtain from you, or that you are responsible for allowing us to obtain, except as permitted by you or as permitted or required by applicable law. For example, we may disclose information in response to a subpoena, to prevent fraud, or to comply with an inquiry by a government agency or regulator.
Under some circumstances, PMI may need to disclose Private information to third parties in order to provide financial products or services to you. In such a case:
- (1) You are not a party to the agreement with the third party;
- (2) PMI will use caution and prudence in the selection of responsible third parties;
- (3) PMI will require that any third party it selects agrees to: (a) adhere to PMI's privacy policies and applicable law in handling the Private information, (b) use the Private information only for the purposes agreed upon, (c) not transfer the Private information further, and (d) to the extent possible, return or destroy the Private information upon either completion of the work or, in any event, not later than the termination of the agreement for services.
Notice of PMI's Privacy Policy
Our business changes constantly. This Privacy Policy will also change, and the use of information we collect now is subject to the Privacy Policy in effect at the time of use. Our Privacy Policy shall continue to apply with regard to the Private information of your customers that we obtain from you, or that you are responsible for allowing us to obtain, even after they are no longer your customers.
